1. Introduction
This End-User License Agreement (“Agreement”) is a legally binding contract between you (“User”) and BIM4CIVIL (“Licensor”) governing the use of BIM4CIVIL software products, including plugins, add-ins, installers, updates, documentation, and related materials (the “Software”).
By downloading, installing, activating, or using the Software, you agree to be bound by this Agreement. If you do not agree, you must not use the Software.
2. License Grant
Subject to full payment and compliance with this Agreement, BIM4CIVIL grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable, time-limited license to use the Software solely for your internal professional or business purposes.
The license is valid only for the specific duration purchased at checkout. No automatic renewal applies.
The Software is licensed, not sold. No ownership rights are transferred.
3. License Duration and Expiration
The license becomes effective upon successful payment and activation.
The license automatically expires at the end of the purchased validity period. Upon expiration, access to the Software may be restricted or disabled.
Continued use requires the purchase of a new license.
4. Ownership and Intellectual Property
All intellectual property rights in the Software remain exclusively with BIM4CIVIL.
You acquire only the limited rights expressly granted under this Agreement. All other rights are reserved.
5. Restrictions
You shall not:
- Reverse engineer, decompile, or attempt to derive source code
- Bypass license validation mechanisms
- Redistribute, resell, sublicense, or transfer the Software
- Remove proprietary notices or branding
- Use the Software to develop competing products
- Use the Software for unlawful purposes
6. License Validation and Enforcement
The Software may require online activation and periodic license validation.
BIM4CIVIL may implement technical measures to enforce licensing terms and prevent unauthorised use.
Failure of license validation may result in restricted functionality or suspension.
7. Updates and Third-Party Dependencies
BIM4CIVIL may provide updates or patches. Certain updates may be required to maintain compatibility.
The Software may depend on third-party software (including Autodesk products). BIM4CIVIL is not responsible for issues caused by changes in third-party platforms.
8. Fees and Taxes
All fees are payable in advance. Payments are processed by third-party providers such as Stripe.
You are responsible for applicable taxes.
9. Refunds
Refunds are governed exclusively by the published Refund Policy. Due to the digital nature of the Software and immediate activation, sales are final except where mandatory law provides otherwise.
10. User Data
You retain ownership of your project data.
BIM4CIVIL may process limited technical and licensing data for activation, validation, security, and support purposes.
Personal data is handled in accordance with the Privacy Policy.
11. Disclaimer of Warranties
The Software is provided “as is” and “as available” without warranties of any kind.
12. Limitation of Liability
To the maximum extent permitted by law, BIM4CIVIL shall not be liable for indirect or consequential damages.
Total liability shall not exceed the total amount paid for the specific license giving rise to the claim.
13. Termination for Breach
BIM4CIVIL may terminate or suspend the license immediately if you breach this Agreement.
Upon termination, you must cease use and uninstall the Software.
14. Governing Law
This Agreement is governed by Swiss law. Disputes shall be subject to Swiss courts, unless mandatory law provides otherwise.
15. Severability
If any provision is held invalid, the remaining provisions remain effective.
16. Entire Agreement
This Agreement constitutes the entire agreement regarding the Software.
